Dropspot Terms of Service
These Terms of Service ("Terms") govern your access to and use of Dropspot, including the Dropspot mobile app, web pages, and related services (the "Service").

By creating an account, using the app, posting a game, or applying to a game, you agree to these Terms. If you do not agree, do not use Dropspot.
The contract language is English. Dropspot is provided, and all communication under these Terms takes place, in English.
What Dropspot Does
Dropspot helps padel players and hosts find, post, and fill last-minute game openings. Dropspot is a coordination tool. We do not own or operate padel clubs, courts, booking platforms, payment systems, transport services, or third-party contact services.
Eligibility
You must be at least 18 years old to use Dropspot. If you are under 18, do not create an account or use the Service. You are responsible for making sure your use of Dropspot is lawful where you use it.
Your Account
You are responsible for your account and for activity under your account. Keep your sign-in method secure. Do not share your account, impersonate another person, create misleading profiles, or use Dropspot if we have suspended or removed your account.
You must provide accurate information, including your city, level, profile details, game details, and contact methods. If your information changes, update it.
Posting And Joining Games
When you post or apply to a game, you agree to act in good faith:
- Post only real openings you are allowed to coordinate.
- Provide accurate start time, club, level, number of spots, price, and notes.
- Apply only when you genuinely intend to attend if accepted.
- Communicate promptly after approval.
- Do not misuse contact details revealed through Dropspot.
- Follow the rules of the club, booking platform, and event organizer.
Dropspot may show reliability signals such as saves, no-shows, attendance confirmations, and other game history. These signals are intended to help users coordinate games, but they may be incomplete or imperfect.
Payments, Clubs, And Third-Party Bookings
Dropspot does not currently process in-app payments for games. Any payment, refund, court booking, club access, cancellation, or fee is handled outside Dropspot between users, clubs, booking platforms, or other third parties.
You are responsible for understanding the price, payment method, refund expectations, cancellation rules, and club requirements before joining or hosting a game. Dropspot is not responsible for payment disputes, booking disputes, venue issues, injuries, no-shows, or cancellations.
Contact Exchange
Dropspot is designed to hide contact values until a player is approved for a game. After approval, the relevant host and approved player may see each other's saved contact methods so they can coordinate the match.
You may use contact information obtained through Dropspot only for the relevant game and reasonable follow-up. Do not spam, harass, scrape, sell, publish, or misuse another user's contact information.
User Content
"User content" means information you submit or make available through Dropspot, such as profile details, photos, public notes, confirmation notes, application messages, booking links, contact methods, and game details.
You keep ownership of your user content. You grant Dropspot a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify for formatting, transmit, and use your user content as needed to provide, secure, improve, and operate the Service.
You represent that you have the rights needed to provide your user content and that it does not violate these Terms, another person's rights, or the law.
Prohibited Conduct
Do not use Dropspot to:
- harass, threaten, abuse, discriminate against, or harm anyone;
- post false, misleading, defamatory, hateful, explicit, or illegal content;
- coordinate illegal activity or unsafe behavior;
- impersonate anyone or misrepresent your identity, availability, or game details;
- spam users or send unwanted commercial messages;
- scrape, harvest, or misuse personal information;
- interfere with, overload, reverse engineer, or attack the Service;
- bypass access controls, security features, moderation, or account restrictions;
- upload malware or harmful code;
- violate club rules, booking-platform rules, app-store rules, or applicable law.
Moderation And Enforcement
We may review, remove, restrict, or refuse content; limit or suspend features; cancel or hide openings; or suspend or terminate accounts if we believe there is a violation of these Terms, risk to users, legal risk, abuse, or misuse of the Service.
You can report concerns or objectionable content by contacting hello@padelday.app. We aim to review reports and act where appropriate, but we do not guarantee any specific outcome.
If we remove your content or restrict, suspend, or terminate your account, we will inform you of the decision, state the reasons, and give you the opportunity to respond, unless we are legally prevented from doing so or immediate action is needed to prevent serious harm, abuse, or legal risk. You can contest a moderation decision by replying to our notice or by contacting hello@padelday.app; we will review contested decisions.
Safety
Padel games involve real-world activity and interactions with other people. Use your judgment. Meet in public venues, follow club rules, communicate clearly, and do not attend if you feel unsafe. Dropspot does not screen users, guarantee user identity, guarantee attendance, or supervise games.
You are responsible for your own health, travel, equipment, payments, and conduct. Games are organized and played between users on their own responsibility; for harm arising from real-world games or interactions between users, we are liable only in accordance with the "Liability" section below.
Third-Party Services
Dropspot may link to or integrate with third-party services such as authentication providers, Supabase, Expo push notifications, Apple, Google, Google Routes, Playtomic, maps, clubs, booking links, phone, Telegram, Instagram, or app stores.
Third-party services are governed by their own terms and privacy policies. Dropspot does not control and is not responsible for third-party services.
App Stores
If you download Dropspot from the Apple App Store or Google Play, your use of the app is also subject to the applicable app-store terms. The app is licensed, not sold, to you. Apple and Google are not responsible for providing support or maintenance for Dropspot unless their own terms say otherwise.
Intellectual Property
Dropspot, including its name, branding, design, software, and content we provide, is owned by Oleg Bystrov or its licensors and is protected by intellectual property laws. These Terms do not give you ownership of Dropspot.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Dropspot for its intended purpose and in accordance with these Terms.
Privacy
Our Privacy Policy explains how we collect, use, share, and protect personal information. By using Dropspot, you also agree to the practices described in the Privacy Policy.
Changes To Dropspot
We continuously develop Dropspot and may modify features where there is a valid reason — such as technical development, security, legal or regulatory requirements, or adaptation to changed usage or third-party services — provided the modification is reasonable for you, taking both parties' interests into account. We may update the app and stop supporting old app versions for these reasons. If we discontinue the Service or a core feature entirely, we will give you reasonable advance notice.
Termination
You may stop using Dropspot at any time and may delete your account in the app. We may suspend or terminate your access if you violate these Terms, create risk, cause harm, or use the Service in a way we reasonably believe is abusive or unlawful. Suspensions and terminations are handled as described in "Moderation And Enforcement": we will inform you, state the reasons, and give you the opportunity to respond, unless legal or safety reasons prevent this.
Sections that by their nature should survive termination will survive, including ownership, the availability and liability provisions, indemnity, dispute terms, and any payment or legal obligations.
Right Of Withdrawal (Widerrufsbelehrung)
If you are a consumer, you have the following statutory right of withdrawal for the user contract concluded with us:
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded (the day you create your Dropspot account). To exercise your right of withdrawal, you must inform us (Oleg Bystrov, Berlin, Germany, email: hello@padelday.app) of your decision to withdraw from this contract by an unambiguous statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient that you send your notification of the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments we have received from you without undue delay and at the latest within 14 days from the day on which we receive the notification of your withdrawal, using the same means of payment that you used for the original transaction, and you will not be charged any fees for the reimbursement. Dropspot is currently provided free of charge, so there is normally nothing to reimburse; withdrawal then simply ends the user contract, and your personal information is handled as described in the Privacy Policy.

Availability And Quality
Dropspot is provided free of charge. We provide the Service with reasonable care and skill, but we do not guarantee that it will be available without interruption or error at all times. We may temporarily restrict availability where necessary for maintenance, security, or capacity reasons.
Information provided by other users or third parties — such as game details, user profiles, club information, prices, travel times, maps, or booking links — originates outside our control, and we cannot guarantee that it is accurate, available, or suitable for you.
Your statutory rights, including any rights you have as a consumer in respect of digital services under §§ 327 ff. of the German Civil Code (BGB), remain unaffected.
Liability
We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and under any guarantee we have expressly given.
In cases of slight negligence, we are liable only for the breach of essential contractual obligations (cardinal obligations) — obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In those cases, our liability is limited to the foreseeable damage typical for this type of contract.
Any further liability for slight negligence is excluded. This limitation also applies in favor of our employees, contractors, and service providers.
Indemnity
If a third party raises claims against us because of content you posted or because you culpably violated these Terms, another person's rights, or the law, you will support us in defending against those claims and compensate us for the resulting damages and reasonable defense costs — in each case only to the extent you are responsible for the violation. This does not apply to the extent we are at fault ourselves, and it does not limit any mandatory consumer protections that apply to you.
Governing Law And Disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.
If you are a merchant (Kaufmann), a legal entity under public law, or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for disputes arising from these Terms is Berlin, Germany. Otherwise, the statutory places of jurisdiction apply.
Changes To These Terms
We may amend these Terms where there is a valid reason — for example changes in the law or case law, new or changed features, security requirements, or changes to third-party services we depend on — and the amendment does not upset the contractual balance to your disadvantage. We will notify you of amendments in text form (for example by email or in-app notice) at least four weeks before they take effect and will update the "Last updated" date. If you do not agree to an amendment, you may terminate your account free of charge before the effective date.
Amendments that materially affect the core of the Service or your essential rights under these Terms require your express consent, for example by in-app confirmation.
